Elle d\u00e9clare clos les d\u00e9bats, prend l\u2019affaire en d\u00e9lib\u00e9r\u00e9 et va se prononcer dans le d\u00e9lai de la loi \u00bb, a d\u00e9clar\u00e9 le g\u00e9n\u00e9ral de brigade magistrat Jean-Claude Nzau Keba, pr\u00e9sident de la composition, \u00e0 l\u2019issue de l\u2019audience tenue lundi \u00e0 Kinshasa.<\/strong><\/p>\n<p>La Haute cour militaire a ainsi pris en d\u00e9lib\u00e9r\u00e9 l\u2019affaire opposant, au degr\u00e9 d\u2019appel, le parquet militaire au commissaire sup\u00e9rieur adjoint Olivier Kanza Duniya, ancien chef de s\u00e9curit\u00e9 de la Premi\u00e8re ministre Judith Suminwa Tuluka, ainsi qu\u2019\u00e0 ses quatre coaccus\u00e9s. Ces derniers sont poursuivis pour arrestation arbitraire et homicide pr\u00e9terintentionnel au pr\u00e9judice du policier de circulation routi\u00e8re Fiston Kabeya, d\u00e9c\u00e9d\u00e9 le 25 mars 2025.<\/p>\n<p>Avant la cl\u00f4ture des d\u00e9bats, la juridiction militaire a entendu le r\u00e9quisitoire du minist\u00e8re public ainsi que les plaidoiries des avocats des parties civiles et de la d\u00e9fense. Le parquet g\u00e9n\u00e9ral des FARDC, par la voix du colonel magistrat Rapha\u00ebl Mukuta Andondo, a requis la confirmation des infractions mises \u00e0 charge des pr\u00e9venus, sollicitant leur condamnation \u00e0 10 ans de servitude p\u00e9nale principale, assortie d\u2019autres peines \u00e0 l\u2019appr\u00e9ciation de la cour.<\/p>\n<p>Selon l\u2019accusation, les cinq pr\u00e9venus auraient violemment pass\u00e9 \u00e0 tabac le policier Fiston Kabeya alors qu\u2019il r\u00e9gulait la circulation, \u00e0 hauteur du supermarch\u00e9 GG Mart. Le minist\u00e8re public soutient qu\u2019ils l\u2019auraient ensuite plac\u00e9 sous des banquettes et continu\u00e9 \u00e0 lui administrer des coups, notamment \u00e0 la t\u00eate. La victime aurait succomb\u00e9 deux jours plus tard \u00e0 l\u2019h\u00f4pital du camp Kokolo, des suites d\u2019une h\u00e9morragie c\u00e9r\u00e9brale, selon un rapport m\u00e9dical vers\u00e9 au dossier.<\/p>\n<p>Du c\u00f4t\u00e9 des parties civiles, la famille du d\u00e9funt, repr\u00e9sent\u00e9e notamment par Me Julio Nkamba, a contest\u00e9 le montant des dommages et int\u00e9r\u00eats accord\u00e9s en premi\u00e8re instance. L\u2019avocat a d\u00e9nonc\u00e9 une omission dans la d\u00e9cision rendue par la cour militaire de Kinshasa\/Gombe, qui n\u2019aurait reconnu qu\u2019une seule partie civile, en l\u2019occurrence la veuve du d\u00e9funt, au d\u00e9triment de son fr\u00e8re \u00e9galement constitu\u00e9 dans la cause. Il a ainsi sollicit\u00e9 la correction de cette irr\u00e9gularit\u00e9 par la Haute cour militaire.<\/p>\n<p>La d\u00e9fense, pour sa part, a rejet\u00e9 en bloc les accusations port\u00e9es contre les pr\u00e9venus, plaidant leur acquittement. Les avocats ont soutenu que les \u00e9l\u00e9ments constitutifs de l\u2019infraction d\u2019arrestation arbitraire ne sont pas \u00e9tablis et que leur client n\u2019aurait ni arr\u00eat\u00e9 ni entrav\u00e9 la libert\u00e9 de la victime. Ils ont \u00e9galement remis en question la coh\u00e9rence du r\u00e9quisitoire du minist\u00e8re public, estimant que celui-ci aurait d\u00fb requ\u00e9rir l\u2019acquittement au regard des arguments d\u00e9velopp\u00e9s au cours de l\u2019instruction.<\/p>\n<p>Le verdict de la Haute cour militaire est attendu dans un d\u00e9lai l\u00e9gal de dix jours.
