{"id":74248,"date":"2026-04-03T22:46:23","date_gmt":"2026-04-03T20:46:23","guid":{"rendered":"https:\/\/lesvolcansnews.net\/?p=74248"},"modified":"2026-04-03T22:52:24","modified_gmt":"2026-04-03T20:52:24","slug":"justice-le-docteur-david-balanganayi-condamne-avec-sursis-pour-violences-sur-une-patiente","status":"publish","type":"post","link":"https:\/\/lesvolcansnews.net\/?p=74248","title":{"rendered":"Justice : le docteur David Balanganayi condamn\u00e9 avec sursis pour violences sur une patiente"},"content":{"rendered":"<p><strong>\u00a0Le docteur David Balanganayi a \u00e9t\u00e9 condamn\u00e9 vendredi 3avril \u00e0 deux mois de prison avec sursis pour coups et blessures simples sur Mme Dorcas Moya, par le tribunal de grande instance de Kinkole, dans l\u2019est de Kinshasa, capitale de la R\u00e9publique d\u00e9mocratique du Congo.<\/strong><\/p>\n<p>Dans son jugement rendu publiquement, le tribunal a \u00e9cart\u00e9 les accusations les plus graves port\u00e9es contre le pr\u00e9venu.<\/p>\n<p><em> \u00ab Par ce motif, le tribunal statuant publiquement et contradictoirement \u00e0 l\u2019\u00e9gard de toutes les parties, le magistrat du parquet entendu, dit non \u00e9tablies en fait et en droit les infractions de torture et d\u2019enregistrement des images et, par cons\u00e9quent, l\u2019en acquitte et le rend libre de toute poursuite. Le condamne \u00e0 deux mois de servitude p\u00e9nale avec sursis pour coups et blessures simples \u00bb,<\/em> a d\u00e9clar\u00e9 le pr\u00e9sident de la composition.<\/p>\n<p>La peine est assortie d\u2019un sursis d\u2019une ann\u00e9e, ce qui signifie que le m\u00e9decin n\u2019ira pas en prison sauf en cas de nouvelle infraction durant cette p\u00e9riode probatoire.<\/p>\n<p>Le tribunal a \u00e9galement requalifi\u00e9 les faits, disqualifiant l\u2019infraction initiale de coups et blessures aggrav\u00e9s en coups et blessures simples, estimant cette derni\u00e8re \u00e9tablie \u00e0 charge du pr\u00e9venu.<\/p>\n<p>Sur le plan civil, l\u2019\u00c9tat congolais, cit\u00e9 comme civilement responsable, a \u00e9t\u00e9 condamn\u00e9 \u00e0 verser des dommages et int\u00e9r\u00eats aux parties civiles.<\/p>\n<p>Une somme de 2.500.000 francs congolais et 3.500.000 francs congolais a \u00e9t\u00e9 allou\u00e9e respectivement \u00e0 Kidimba Kongolo Jean et Dorcas Moya.<\/p>\n<p>Cette affaire avait suscit\u00e9 une vive \u00e9motion \u00e0 Kinshasa ces derniers jours, apr\u00e8s la diffusion sur les r\u00e9seaux sociaux d\u2019une vid\u00e9o montrant le m\u00e9decin en train de porter des coups \u00e0 une patiente.\u00c0 la barre, le docteur Balanganayi avait expliqu\u00e9 avoir agi dans un contexte m\u00e9dical, affirmant qu\u2019il s\u2019agissait d\u2019un moyen de contrainte destin\u00e9 \u00e0 forcer la patiente \u00e0 accepter des soins n\u00e9cessaires \u00e0 sa survie.<\/p>\n<p>Le jugement rendu vendredi met fin \u00e0 une affaire largement comment\u00e9e dans l\u2019opinion publique congolaise.<\/p>\n<p>La R\u00e9daction<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0Le docteur David Balanganayi a \u00e9t\u00e9 condamn\u00e9 vendredi 3avril \u00e0 deux mois de prison avec sursis pour coups et blessures simples sur Mme Dorcas Moya, par le tribunal de grande<\/p>\n","protected":false},"author":13,"featured_media":74251,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[51],"tags":[],"class_list":["post-74248","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-justice"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 -
