La Cour de cassation de la R\u00e9publique d\u00e9mocratique du Congo a condamn\u00e9 mardi l\u2019ancien ministre de la Justice, Constant Mutamba, \u00e0 trois ans de travaux forc\u00e9s pour le d\u00e9tournement de fonds publics destin\u00e9s \u00e0 la construction d\u2019une prison \u00e0 Kisangani, chef-lieu de la province de la Tshopo (nord-est du pays).<\/p>\n

Outre la peine principale, la Cour a \u00e9galement prononc\u00e9 une interdiction d\u2019acc\u00e8s \u00e0 toute fonction publique pendant cinq ans \u00e0 compter de l\u2019ex\u00e9cution de la peine, ainsi que plusieurs peines compl\u00e9mentaires.<\/p>\n

\u00ab La Cour de cassation dira \u00e9tabli l’infraction de d\u00e9tournement des deniers publics \u00e0 charge du pr\u00e9venu Constant Mutamba, le condamne \u00e0 3 ans de travaux forc\u00e9s, \u00e0 l’interdiction pour 5 ans apr\u00e8s l’ex\u00e9cution de la peine de droit de vote et de droit d’\u00e9ligibilit\u00e9, \u00e0 l’interdiction d’acc\u00e8s aux fonctions publiques et para\u00e9tatiques, quelle qu\u2019en soit la nature ou l\u2019\u00e9chelon, \u00e0 la privation du droit \u00e0 la lib\u00e9ration conditionnelle, ordonne la mainlev\u00e9e de la saisie, la restitution des 19 millions de dollars am\u00e9ricains et le condamne au paiement de frais d\u2019instance \u00bb,<\/em> a d\u00e9clar\u00e9 le pr\u00e9sident de la composition, le juge Jacques Kabasele, en rendant l\u2019arr\u00eat.<\/p>\n

Le minist\u00e8re public avait requis dix ans de travaux forc\u00e9s, assortis d\u2019une interdiction d\u2019acc\u00e8s aux fonctions publiques et para\u00e9tatiques, ainsi que la privation des droits civiques, dont le droit de vote et d\u2019\u00e9ligibilit\u00e9, pour une p\u00e9riode \u00e0 d\u00e9terminer.<\/p>\n

L\u2019annonce du verdict est intervenue dans un contexte tendu dans la capitale congolaise. Dans la nuit de lundi \u00e0 mardi, vers trois heures du matin, la police a dispers\u00e9 plusieurs dizaines de partisans de M. Mutamba rassembl\u00e9s devant sa r\u00e9sidence \u00e0 Kinshasa pour manifester leur soutien. L\u2019ancien ministre a \u00e9t\u00e9 ensuite plac\u00e9 sous mandat de d\u00e9p\u00f4t.<\/p>\n
